The Crazy-Ass VA - Part 2

I can’t get over the feeling that the VA hires legal assistance to fight against veterans in disability claims. I mean, that sounds to me like they are not in the game of helping out a veteran, now does it?

I understand that there are some people out in the world who would take advantage of the system, hell, they already take advantage of the social services systems, so why not the VA?

But hear me out here, the VA denied one claim of mine, but they put in the notes that I should file for Chronic Sinusitis. I looked back through all of my claims and Sinusitis was part of the very first claim I filed several years back. This time, I went for my C&P exam, and the practitioner said, that she had already once stated that I have Chronic Sinusitis, and she said that they will state it again on this claim.

Sure enough, I was already once denied Sinusitis which is all the more confusing.

When I was at my C&P exam, the practitioner and I were talking and she said that she feels that the VA really fights for the veterans, but why am I getting denied? The practitioner said that I had it. They shouldn’t schedule a C&P exam unless they can make it service-connected, so why the denial?

Most of the time, when you are denied, you get a statement as to why you were denied like my RA and Fibro claim was denied because the “evidence was irrelevant”. This means that the 56 pages I sent them, were all bullshit in their eyes., I mean, I had doctors’ statements, I had buddy letters, I had doctors’ exams, test results, and a nexus letter, I did everything except hold their fucking hand on it. All that and they denied it. And as a veteran, I have nowhere to go now, but to hire a lawyer, all because of the 100% bullshit statement that my “evidence is irrelevant”, I mean, what the hell does that mean and how do I make my evidence relevant?

When I called a few weeks back about the C&P appointment for the RA and Fibro, I had them reschedule me for a practitioner who is a little closer to my house, so I don’t have to take off a half day of work (unpaid) for all this BS, They were nice enough to arrange that for me. I’m not even sure why I have to do the C&P exam, since the claim was closed, months ago.
